How to Post on a Gold Claim

 

In the cases in which a survey needs to get done, the patent applicant will need to post a copy of the plat and notice of intention so that he is then able to apply for patent before the application is made. In the cases in which a survey is not necessary or required, it will only be necessary to post a notice of intention to be able to apply for the patent. The papers that are sent out need to be protected from weathering and elements, but need to be placed in a noticeable place on the claim or on one of the groups of the claims. The papers have to stay posted on the claim for the entire sixty day publication period, and then the claimant will need to make a sworn statement indicating that the plat and notice remained to be posted for this amount of time.

Applying for a patent
Those that are applying for a patent need to fill out an application for patent, which needs to be filled in duplicate. There is also a non refundable fee that needs to be paid. The application needs to demonstrate the right of possession to the claim and briefly but clearly indicate the specifics that make up the basis of the applicants right to patent. In other words, the person will need to show that he has discovered a valuable mineral deposit inside the limits of the claim that is located there. Remember also that a minimum of $500 needs to have already been expended on the development of the claims. It will be necessary to state whether the applicant has had any direct or indirect part in the development of the atomic energy program. The application, as well as the statements that provide support, are required to be signed in the land district where the claim is located. If there are any individual claimants they are required to sign the application. If the claimant is not present, the application would in this case need to be signed by the attorney in fact inside of the land district. It will be necessary for the attorney of an individual to have a certified or original copy of Power of Attorney. The application that is done by a corporation can be signed by an agent or officers or fittingly attorney that has been granted authorization.
