Certificate of Gold Claim Title
The certificate of title or the abstract that an applicant for a patent provides has to be an up to date certificate and needs to be close to the date the application has been filed in. This needs to be carried out by a state authorized abstractor or by a title company and in a way that is agreeable to the Director of the Bureau of Land Management. As soon as it can be done, the applicant will need to file a supplemental certificate or abstract close to the date of filing or application. The applicant, as proof of the ownership of his claim, instead of providing a certificate or abstract of title, can provide a certified copy of the statute of limitations that can be applied to mining claims in the state. Besides this, the applicant can provide a statement that has the following information in it:
- The basis and maintenance of his title.
- The claim area.
- The quantity and extent of mining developments that have been done.
- If the title has been disputed in court dealings or the like, and should explain such in full detail.
- Additional matters that he knows of that would weigh on his right of possession.
The statements that have just been mentioned need to be supported by statements of any individuals that are not interested but know about the facts that have to do with the location of the applicant, the occupancy, possession, improvements that have been made and so forth. It will also be necessary for an applicant to file a certificate, under the seal of the court having jurisdiction, that a suit or action that involves the right of possession to the claim is not still hanging in the air. This certificate will also need to indicate that there has not been any litigation in the court that would affect the title to the claim for the time fixed by the statutes of the state of limitations besides what has been decided in favor of the applicant of the patent.
- Evidence of citizenship is also necessary. Statements of citizenship can also be signed inside or outside of the land district by:
- A person who was born in the country and who will need to state that fact and provide the date and place of birth.
- A person that has declared that his intentions to turn into a citizen or a person that has been naturalized. This person will need to have a statement that provides a date, place and the court he appeared to give his intention or from which his naturalization papers came, besides this, the number if this is known of.
- One association that needs to provide proficient evidence that is relative to the evidence of citizenship and persons that are born in the country as far as each of the members.
- A corporation that needs to provide a certified copy of the certificate of incorporation.
- Payment of the filing fee needs to be provided.
- An agreement of the publisher. The land office manager will assign the newspaper where the publication will come out.
- A notice for publication is required and needs to be published at the expense of the applicant.
- A notice for posting in land office is also required.
